Inda + Mely — Terms of Service

By accessing or using our website, phone, or text services, you agree to these Terms of Service.
1. Use of Website. You agree to use this website only for lawful purposes. You may not use the site
in a way that violates any applicable laws, attempt to gain unauthorized access, or interfere with
website functionality.
2. Reservations, Orders, and Catering. Reservation, order, and catering requests submitted by
website, phone, or text are requests only and are not guaranteed until confirmed by Inda + Mely. We
reserve the right to decline service at our discretion.
3. Pricing and Menu Information. All menu items, pricing, and availability are subject to change
without notice. We make reasonable efforts to ensure accuracy but do not guarantee that all
information is error-free. Any prices or quotes given by our automated assistant are estimates and
are not binding until confirmed.
4. Food Allergies and Information. Menu, ingredient, and allergen information provided by phone,
text, our automated assistant, or this website is for general guidance and may change; it is not a
guarantee against allergens or cross-contact. If you have a food allergy or dietary restriction, please
tell a staff member directly before ordering. Our automated assistant does not provide medical or
dietary advice.
5. Automated Assistant. Some calls and messages are handled by an automated assistant. It
cannot authorize discounts, refunds, comps, or exceptions, and it does not take payment or card
numbers by phone. It discloses that it is automated and connects you with a person on request.
6. Text Message (SMS) Terms. By providing your phone number to Inda + Mely (including during a
reservation, order, or callback), you consent to receive transactional text messages related to your
orders, reservations, and catering. Consent to receive texts is not a condition of any purchase.
Message types include order confirmations, pickup-readiness notifications, reservation
confirmations, and catering updates. Message frequency varies (typically 1–3 messages per
transaction). Message and data rates may apply. Reply STOP to any message to opt out (you will
receive one confirmation and no further messages); reply HELP, or contact (650) 392-0363, for help.
We do not sell or share your opt-in information. Supported carriers include AT&T, Verizon, T-Mobile,
and most major US carriers, which are not liable for delayed or undelivered messages.
7. Intellectual Property. All content on this website — including text, images, logos, and design
elements — is the property of Inda + Mely and may not be reproduced without permission.
8. Third-Party Links and Services. Our website may link to or integrate third-party services, such
as online ordering and reservations. We are not responsible for the content or practices of third-party
websites.
9. Disclaimer. The website and its content are provided on an "as is" basis without warranties of
any kind, either express or implied.
10. Limitation of Liability. Inda + Mely shall not be liable for any indirect, incidental, or
consequential damages arising from use of our website, phone, or text services.
11. Dispute Resolution — Arbitration and Class-Action Waiver. Any dispute relating to these
Terms, our services, calls, or text messages will be resolved by binding individual arbitration, not in
court, except that either party may bring qualifying claims in small-claims court. You and Inda + Mely
LLC waive any right to a jury trial and to bring or participate in a class, collective, or representative
action. If any part of this section is found unenforceable, the remainder stays in effect.
12. Governing Law. These Terms are governed by the laws of the State of California.
13. Severability and Entire Agreement. If any provision of these Terms is found unenforceable, the
remaining provisions remain in effect. These Terms, together with our Privacy Policy, constitute the
entire agreement between you and Inda + Mely regarding your use of our website and services.
14. Changes to Terms. We may update these Terms at any time. Continued use of our website or
services constitutes acceptance of any changes.
